Government Confirms No Changes to Accredited Driver Training Centre Regulations

Delhi - In response to recent media reports, it has been clarified that the provisions for Accredited Driver Training Centres (ADTC) under Rules 31B to 31J of the Central Motor Vehicles Rules (CMVR), 1989, implemented via GSR 394(E) dated June 7, 2021, remain effective from July 1, 2021, with no changes anticipated from June 1, 2024.

Motor Vehicles (MV) Act, 1988:

Section 12 of the MV Act, 1988, governs the licensing and regulation of driving schools or establishments. The Motor Vehicles (Amendment) Act, 2019, introduced subsections (5) and (6), allowing for the accreditation of these establishments by a body notified by the Central Government.

Accreditation Process:

The State Transport Authority or any authorized agency notified by the Central Government, based on recommendations from a testing agency referred to in rule 126 of CMVR, 1989, can grant accreditation to ADTCs.

Certification and Exemptions:

ADTCs issue a certificate (Form 5B) upon successful course completion, exempting the holder from the driving test requirement as per rule 15(2) of CMVR, 1989.

Other driving schools, established under rule 24 of CMVR, 1989, issue a certificate (Form 5) but this does not exempt the holder from the driving test requirement.

Licence Application:

Applications for a driving licence under rule 14 of CMVR, 1989, must include either Form 5 or Form 5B, as applicable.

Licensing Authority:

Regardless of the driving test exemption, the authority to issue a driving licence remains with the licensing authority.

This clarification ensures that there are no changes to the ADTC rules effective from June 1, 2024, and emphasizes the ongoing regulatory framework for driver training and licensing.
